Costner vs. Baumgartner: Court Limits Item Removal Amidst Divorce Proceedings

Created: JANUARY 01, 2025

In a swift court decision, a judge ruled that Christine Baumgartner, Kevin Costner's estranged wife, can only remove personal items like toiletries, clothing, handbags, and jewelry from their shared Carpinteria home. Baumgartner is prohibited from removing furniture, furnishings, appliances, artwork, or items from any storage units without a written agreement or further court order.

While neither party was present in court, Costner's lawyer, Jacqueline Misho, reiterated the actor's desire to ensure Baumgartner only removes agreed-upon items. Judge Thomas Anderle stressed the importance of resolving the property dispute before the November trial concerning their prenuptial agreement.

Costner's legal team argued against Baumgartner removing items from the home without his explicit consent, citing the prenuptial agreement's stipulation of no community property. The contested items include household goods like pots, pans, appliances, and a Peloton. Costner's petition highlights Baumgartner's access to $1.5 million, suggesting she has ample resources to purchase new household items.

Baumgartner's lawyers characterized the hearing as a smear campaign by Costner, alleging he is using the situation to manipulate public opinion. They emphasized Costner's substantial income and net worth, questioning his concern over seemingly minor household items. Meanwhile, Costner is currently on vacation with their two sons.

Court documents also revealed Baumgartner's use of $25,000 for a criminal defense law firm without Costner's knowledge, raising questions about the nature of these legal expenses. Baumgartner was previously ordered to vacate the $145 million Carpinteria compound by July 31, per the prenuptial agreement. Her request for an extension was denied despite arguments about the challenging Santa Barbara housing market. Baumgartner filed for divorce in May, citing irreconcilable differences.

Baumgartner will receive $129,755 in monthly child support, and Costner will cover $200,000 in attorney fees and $100,000 in forensic costs. They will share the children's healthcare, sports, and extracurricular expenses equally. Baumgartner's initial request for $248,000 per month in child support, with Costner covering all other expenses, was significantly higher.
