Justice Alito Clarifies Call with Trump, Denies Discussing Pending Legal Matters

Created: JANUARY 26, 2025

Supreme Court Justice Samuel Alito addressed concerns regarding a phone call with former President Donald Trump, emphasizing that the conversation focused solely on a former clerk's job prospects and did not involve any pending legal matters. The call occurred the day before Trump's Supreme Court appearance related to his New York hush-money case.

In a statement to Fox News, Justice Alito confirmed the call took place at the request of his former clerk, William Levi, who was seeking a government position. Alito stated he agreed to speak with Trump about Levi's qualifications and praised Levi's "impressive credentials." He explicitly denied discussing Trump's emergency application to delay sentencing in the hush-money case, stating he was "not even aware" of the application at the time of the call.

Alito further emphasized that no discussions occurred regarding any pending or potential future cases before the Supreme Court, including past decisions involving Trump. He clarified that recommending former clerks for positions is common practice. Levi previously served in the Justice Department during Trump's first term.

Despite Alito's explanation, the timing of the call raised questions and drew criticism from some, who viewed it as a breach of protocol. Gabe Roth, executive director of Fix the Court, expressed concern about any out-of-court communication between a judge and an individual involved in a case before them. Alito reiterated to Fox News that the call was solely about Levi and that no legal issues related to Trump were discussed.
