Trump Seeks Supreme Court Intervention to Halt Sentencing in New York Case

Created: JANUARY 26, 2025

Former President Donald Trump has petitioned the U.S. Supreme Court to intervene in his New York criminal case, aiming to prevent his scheduled sentencing on January 10th. A jury previously found Trump guilty of falsifying business records, a charge stemming from Manhattan District Attorney Alvin Bragg's investigation. Trump, who has pleaded not guilty and appealed the verdict, is seeking to halt the proceedings based on arguments of presidential immunity.

Trump's spokesperson, Steven Cheung, characterized the case as a "meritless hoax" and a "political weaponization of our justice system." He expressed confidence that the Supreme Court would dismiss the case and emphasized the public's support for Trump's presidency.

Trump's legal team argues that the New York court erred by admitting evidence related to official presidential acts, contravening the Supreme Court's ruling on presidential immunity. They contend that the ongoing proceedings and impending sentencing should be suspended until the appeal, which they believe will ultimately lead to the dismissal of the case, is resolved.

The Supreme Court's earlier decision established presidential immunity from prosecution for actions taken in an official capacity. Trump's lawyers assert that the New York case is politically motivated and based on false claims. They maintain that the trial court lacks the jurisdiction to proceed with sentencing until the appeal, which raises significant presidential immunity claims, is fully adjudicated, potentially by the Supreme Court itself.

This appeal to the Supreme Court follows a New York judge's denial of Trump's motion to postpone the sentencing. While the judge indicated that incarceration is unlikely, opting instead for an unconditional discharge, Trump's team continues to pursue legal avenues to halt the proceedings entirely. Trump's inauguration as the 47th president is scheduled for January 20th. He has consistently maintained his innocence and denounced the case as politically motivated "lawfare" designed to undermine his election prospects.
