Macey Boggs, a former University of Wyoming volleyball player, testified before the Wyoming state senate about her team's decision to forfeit matches against San Jose State University (SJSU) rather than compete against a transgender athlete, Blaire Fleming. This forfeiture cost Wyoming a spot in the Mountain West Tournament, ending Boggs' collegiate career.

Boggs and ten other current and former Mountain West volleyball players, along with a former SJSU assistant coach, are suing SJSU and the conference. Their lawsuit alleges, among other things, that SJSU prioritized Fleming's rights over the safety and competitive fairness concerns of the other female athletes. Boggs testified in support of a Wyoming bill requiring athletes to compete based on their biological sex at birth. The bill passed, adding Wyoming to the growing list of states with similar legislation.

Boggs argued that being forced to choose between competing against a transgender athlete and forfeiting their season placed an unfair burden on her and her teammates. She emphasized the importance of fair competition and the need to protect women's sports. Her testimony resonated with Wyoming state senator Wendy Schuler, a former college athlete herself, who sponsored the bill.

The lawsuit also includes allegations from SJSU co-captain Brooke Slusser, who claims she was required to share private spaces with Fleming, an experience she describes as "traumatic." The controversy has led to a mass exodus of players from the SJSU volleyball program, with nearly all eligible players seeking transfers.

Riley Gaines, a former NCAA swimmer and advocate for women's sports, spoke about the SJSU players' experiences during a hearing in Idaho, stating that the players felt pressured and feared repercussions for voicing their concerns. Marshi Smith, co-founder of the Independent Council on Women's Sports, echoed these sentiments, adding that players felt threatened with retaliation for speaking out against transgender inclusion.
