Alec Baldwin Sues New Mexico Officials for Malicious Prosecution After 'Rust' Shooting Case Dismissal

Following the dismissal of the involuntary manslaughter case against him, actor Alec Baldwin has filed a lawsuit against several New Mexico officials. The suit, filed in Santa Fe's First Judicial District Court, alleges civil rights violations, including malicious prosecution, abuse of process, and defamation. Baldwin claims the officials, including special prosecutor Kari Morrissey and District Attorney Mary Carmack-Altwies, intentionally withheld evidence and sought to make him a scapegoat for the 2021 on-set shooting of Halyna Hutchins. He is seeking compensatory and punitive damages and has requested a jury trial.

Baldwin's lawsuit asserts that the defendants improperly used the criminal process against him, conspiring to secure a baseless indictment and pursue his conviction despite a lack of evidence. The dismissal of the case came after Judge Mary Marlowe Sommer ruled that the prosecution had concealed crucial evidence from the defense, a move she deemed intentional and prejudicial. Baldwin's legal team celebrated the dismissal as a vindication of their client's innocence.

Special prosecutor Kari Morrissey voluntarily testified Friday, July 12 in Alec Baldwin's involuntary manslaughter trial.

The lawsuit follows Morrissey's withdrawal of the state's appeal against Baldwin, solidifying the judge's decision. The tragic shooting occurred during a rehearsal for the film "Rust" when a revolver Baldwin was holding discharged, killing Hutchins and injuring director Joel Souza. Baldwin maintains he did not pull the trigger. The film's armorer, Hannah Gutierrez Reed, was convicted of loading a live round into the weapon and sentenced to prison. The Santa Fe District Attorney's Office has been contacted for comment.
