Biden Administration Defers TikTok Ban Enforcement to Incoming Trump Administration

Created: JANUARY 26, 2025

The Biden administration has confirmed it will not enforce the impending ban on TikTok, leaving the popular social media platform's future in the hands of the incoming Trump administration. This decision follows a Supreme Court ruling upholding the federal law that mandates TikTok's sale to a U.S. entity to address national security concerns.

White House Press Secretary Karine Jean-Pierre stated that President Biden's stance on TikTok has been consistent: the app should be accessible to Americans, but under ownership that mitigates the national security risks identified by Congress. Due to the timing of the Supreme Court decision, the implementation of the ban will fall to the next administration.

The Supreme Court's ruling acknowledges TikTok's significance as a platform for expression and community for over 170 million Americans. However, the court affirmed Congress's determination that divestiture is essential to address national security concerns related to TikTok's data collection practices and its connection to a foreign adversary.

The law, signed by President Biden last year, requires TikTok's Chinese parent company, ByteDance, to divest the company. Congress raised concerns about potential exploitation and data collection due to the app's Chinese ownership.

During oral arguments, the Biden administration's legal team emphasized the "grave" national security risk posed by TikTok's Chinese ownership, while TikTok's lawyers argued that a ban infringes upon First Amendment rights.

This case highlights the tension between national security concerns and free speech protections, with the Supreme Court ultimately upholding the law requiring TikTok's divestiture.
