Former head of the Department of Justice's tax division, Eileen J. O'Connor, expressed serious concerns regarding the plea agreement reached with Hunter Biden, citing compelling testimony from IRS whistleblower Gary Shapley. In a recent appearance on 'Jesse Watters Primetime,' O'Connor stated that Shapley's account of the investigation left her astounded. She believes the plea deal should be rejected by the presiding judge.
O'Connor emphasized the importance of transparency and informed citizenry in a functioning democracy, prompting her to write an op-ed on the matter. Drawing on her extensive experience in tax law, she carefully examined Shapley's testimony. A particular revelation on page 95 of the testimony caught her attention, leading her to question the handling of the investigation.
According to O'Connor's interpretation of Shapley's testimony, the prosecution team knew as early as June 2021 that jurisdictional limitations, tied to the location where crimes occurred, would hinder the prosecution of Hunter Biden on tax charges. Because Attorney General Garland did not appoint U.S. Attorney Weiss as special counsel, Weiss lacked the authority to prosecute alleged tax crimes that occurred outside his Delaware jurisdiction, specifically those potentially occurring in the District of Columbia and Los Angeles.

Shapley, who oversaw the IRS investigation into Hunter Biden, has publicly asserted that key aspects of the investigation were delayed as the 2020 presidential election drew near. He contends that significant felony charges were ultimately excluded from consideration. In an interview with Fox News, and in prior testimony before the House Ways and Means Committee, Shapley alleged that investigators were instructed by DOJ prosecutors to avoid inquiries related to President Biden. He further claimed that search warrants pertaining to Hunter Biden were not pursued. Shapley specifically stated that investigators were prevented from asking about "dad," "the big guy," or including certain names in official documentation.
